UNBRAND3D – Master Terms of Service & Customer Agreement

By approving an estimate, submitting a purchase order, paying an invoice, or submitting equipment/files for service, you (“Customer”) agree to be bound by the terms and conditions outlined below by UNBRAND3D (“Service Provider”).
1. Custom 3D Printing & Additive Manufacturing

File & Design Responsibility: All parts are produced based strictly on digital files (e.g., STL, STEP, 3MF) and specifications supplied or approved by Customer. UNBRAND3D does not validate engineering calculations, load limits, or mechanical tolerances unless specifically contracted for engineering validation in writing.

“As-Is” Production & Tolerances: Parts are provided “as-is” within standard additive manufacturing tolerances. Variations in surface finish, layer lines, support contact points, and minor cosmetic variations are inherent to FDM/Resin manufacturing processes and do not constitute defective manufacturing.

Non-Critical & Prototype Use: Unless explicitly certified in writing, parts printed by UNBRAND3D are intended solely for functional testing, aesthetic evaluation, or rapid prototyping. They are not certified for safety-critical, medical, aerospace, automotive, or life-support applications.

Intellectual Property Warranty: Customer warrants that they own or hold valid licenses for all designs, files, and trademarks submitted. Customer agrees to fully indemnify and hold harmless UNBRAND3D from any claims of intellectual property or patent infringement arising from fulfilling the order.
2. Design & Prototyping Services

Scope of Work: Design, CAD modeling, and reverse-engineering services are billed based on agreed project scope or hourly rates. Scope expansions require a written change order.

File Ownership: Source CAD files (e.g., parametric CAD, raw design models) remain the intellectual property of UNBRAND3D until all associated development fees and file-transfer release fees are paid in full.

Client Approvals: UNBRAND3D is not liable for errors, omissions, or fitment defects in the final physical parts if the digital proof or initial prototype was reviewed and approved by Customer.
3. Printer Diagnostic, Tuning & Repair Services

Diagnostic Fees: A non-refundable diagnostic fee applies to all equipment intake. This fee covers inspection, teardown, and troubleshooting time and may be credited toward approved repair labor at UNBRAND3D’s discretion.

No Guarantee of Resolution: Due to proprietary parts, third-party firmware, or preexisting hardware wear, UNBRAND3D does not guarantee full resolution or factory-grade performance on modified or legacy machines.

Pre-Existing Conditions & Liability: UNBRAND3D is not liable for preexisting damage, worn consumables, corrupted SD cards, warped build plates, or latent mainboard/electrical failures.

Abandoned Equipment Policy: Equipment left unclaimed for more than 30 calendar days following notification of completion or estimate rejection will be deemed abandoned and surrendered. UNBRAND3D reserves the right to recycle, sell, or dispose of abandoned equipment to recover diagnostic and storage expenses.
4. Financial Terms & Limitation of Liability

Payment & Retainers: Custom print runs and repair parts require advance payment or deposit as outlined on the invoice. B2B net-terms, where granted, are subject to late payment interest of 1.5% per month.

Strict Cap on Liability: In no event shall UNBRAND3D, its owners, or contractors be liable for indirect, incidental, punitive, or consequential damages (including loss of revenue, assembly line downtime, equipment damage, or personal injury).

Maximum Recovery Limit: UNBRAND3D’s total aggregate liability arising out of any order or service shall never exceed the exact dollar amount paid by Customer for that specific job or invoice.
